Criminal Law Qualification of Continuing Mining After the Expiration of a Mining License

Abstract：Thequestionofwhether miningactivitiesconductedafter theexpirationofamining licenseconstitutecriminalillegalityisa materof disputeinboth theoryand practice.Theprotected legalinterestsof thecrimeofillegal miningare the order of national mineral resource management and the state'sownership of mineral resources. The mining right has both public and private law atributes，while the mining licenseonly represents its public law attribute，leading to a phenomenonof“separation of rights and certificates”.Therefore，thecontinuation of mining beyond the license period does not necessarily implythat the state's ownership of mineral resources has been infringed upon. The temporary protective efect of theimplied extensionof permitsalows fortheposibilityofcontinuity betweenoldand new licenses.Thecontinuityof the mininglicense should be thecore focus，only whentheoriginal mining licenseexpires andcannot be extended through administrative extension systems，and the original licensee continues toexploit mineral resources，does itconstitute the actus reus of the crime of illegal mining.

一、問題的提出
我國刑法對非法開采礦產(chǎn)資源行為的規(guī)制進行過多次調(diào)整，1997年刑法頒布以前，對于此種行為按照“故意毀壞公私財物罪”定罪處罰，后在1997年頒布的刑法中單獨設(shè)立了非法采礦罪。（剩余15143字）
