生態(tài)文明視域下新《森林法》基本原則與制度建構(gòu)

摘要  從習(xí)近平生態(tài)文明思想的立法實(shí)踐出發(fā)，探討新《森林法》確立的生態(tài)安全、和諧共生、可持續(xù)發(fā)展的價(jià)值目標(biāo)，據(jù)此分析新《森林法》中生態(tài)優(yōu)先、保護(hù)優(yōu)先、保育結(jié)合、可持續(xù)發(fā)展基本原則的內(nèi)涵，進(jìn)而論證這一原則主要通過(guò)森林資源保護(hù)制度、森林資源經(jīng)營(yíng)管理制度及森林資源永續(xù)利用制度來(lái)實(shí)現(xiàn)。

The Basic Principles and System Construction of the New Forestry Law from the Perspective of Ecological Civilization

Abstract  This article starts from the legislative practice of Xi Jinping’s thoughts of ecological civilization， discusses the values of ecological safety， harmony between human and nature and sustainable development established by the newly amended Forestry Law，and then analyzes the fundamental principles of giving priority to ecology and protection， combining reservation and protection as well as the sustainable development contained therein. This article further demonstrates that the aforementioned principles are mainly realized via the implementation of forestry resources protection systems， forestry resources operation and management systems and forestry resources sustainable exploitation systems.
