綁架贖金的發(fā)展演進(jìn)法理分析及應(yīng)對(duì)建議

摘要：綁架贖金出現(xiàn)在綁架案件、恐怖主義犯罪和海盜案件中，催生了綁架贖金險(xiǎn)的問(wèn)世和各國(guó)贖金規(guī)則的產(chǎn)生。贖金具有特殊的性質(zhì)和特點(diǎn)，各國(guó)對(duì)贖金的合法性與合理性進(jìn)行了探討，采取的態(tài)度各不相同。我國(guó)對(duì)贖金問(wèn)題應(yīng)當(dāng)結(jié)合理論與實(shí)踐采取恰當(dāng)?shù)膽?yīng)對(duì)策略，制定符合國(guó)情的贖金規(guī)則。

On the Development， Jurisprudential Analysis and Countermeasures of Kidnapping Ransom

Abstract：Ransom appears in cases of kidnapping， terrorism and piracy， which leads to the emergence of Kidnap&ransom insurance and ransom rules in various countries. Ransom has special nature and characters， various countries have discussed the legality and rationality of ransom and adopted different attitudes. China should take appropriate countermeasures to the ransom problems in combination with theory and practice， and formulate ransom rules in accordance with national conditions.
