從合謀到合作：營(yíng)商環(huán)境法治化建設(shè)中的政企關(guān)系嬗變

摘要：“法治缺失”與“法治完備”成為區(qū)分政企合謀與政企合作的基本標(biāo)準(zhǔn)。政企合謀從理論構(gòu)造、實(shí)踐生成以及制度困境等方面影響著營(yíng)商環(huán)境制度框架的現(xiàn)實(shí)展開。為了完成由政企合謀向政企合作的理論與實(shí)踐嬗變，需要通過(guò)法治回歸以實(shí)現(xiàn)規(guī)范體系的兼容重構(gòu)，通過(guò)主體擴(kuò)容以達(dá)成多元共治背景下的治理結(jié)構(gòu)變遷。

From Collusion to Cooperation： The Evolution of the Relation Between Government and

Business in the Legalization of Business Environment

Abstract：“Absence of the rule of law”and“Complete rule of law”have become the basic criteria to distinguish between government-business collusion and government-business cooperation. The collusion affects the actual development of the business environment institutional framework in terms of theoretical structure， practical generation， and institutional dilemmas. In order to complete the theoretical and practical evolution from the collusion to the cooperation， it is necessary to realize the compatible reconstruction of the normative system through the return of the rule of law; the expansion of the main body to achieve the change of governance structure under the background of multiple co-governance.
