基于利益沖突的科技成果轉(zhuǎn)化廉政風(fēng)險(xiǎn)防控管理建議和運(yùn)行機(jī)制研究

摘要：文中以高校院所科技成果轉(zhuǎn)化貪腐案例為切入點(diǎn)，分析科技成果轉(zhuǎn)化過(guò)程中存在的主要廉政風(fēng)險(xiǎn)，提出基于利益沖突的廉政風(fēng)險(xiǎn)防控管理建議，并結(jié)合高校院所實(shí)際情況，構(gòu)建了基于利益沖突的科技成果轉(zhuǎn)化廉政風(fēng)險(xiǎn)防控管理運(yùn)行機(jī)制。

Research on Risk Prevention and Control in the Transformation of Scientific and Technological Achievements with a Focus on Clean Government Based on Conflict of Interest

Abstract： Taking corruption cases of scientific and technological achievements transformation in universities and institutions as the starting point， this paper analyzes the main risks of corruption in the process of transforming scientific and technological achievements， puts forward suggestions on prevention and control management of clean government risks based on interest conflicts， and builds an operation mechanism for prevention and control management of scientific and technological achievements transformation based on interest conflicts in combination with the actual situation of universities and institutions.

近年來(lái)，國(guó)家、各省份陸續(xù)推出了一系列旨在促進(jìn)科技成果轉(zhuǎn)化的法律法規(guī)，部分省份也推出了具有針對(duì)性的小切口立法，比如福建省擬出臺(tái)的《福建省職務(wù)科技成果管理規(guī)定》等，但科技成果轉(zhuǎn)化法律體系仍不夠完善，有些情況下，科技成果轉(zhuǎn)化政策與財(cái)政、審計(jì)、紀(jì)檢、人事等監(jiān)管要求之間存在一定程度的沖突；特別是近幾年科技領(lǐng)域發(fā)生的科技成果轉(zhuǎn)化相關(guān)貪腐案例，也凸顯了科技工作者在法律意識(shí)方面的不足。（剩余7705字）
